Per a report, Mark Cuban requested during the discovery hearing regarding the Voyager Digital case conducted on January 6, 2023, to have the deposition split into two sessions. The topic of whether Billionaire Mark Cuban’s deposition will be limited to jurisdictional issues and the date fellow defendant Dallas Mavericks must produce employees Ryan Mackey and Kyle Tapply to be deposed. 

For context, the term deposition is used when a defendant in a court case answers questions under oath during the discovery phase of a legal battle in the buildup of a potential trial. Accordingly, United States Magistrate Judge Lisette M. Reid denied Cuban’s request to bifurcate discovery allowing the plaintiffs to initially depose witnesses regarding solely jurisdictional issues. 

The judge equally noted that Mark Cuban’s deposition will not be limited to jurisdictional issues, scheduling it to take place in Dallas, Texas, on February 2, 2023. Lied stressed that the deposition will be taken in full, further denying the Shank Tank investor’s request.

Part of the letter read, “Defendants shall produce Mavericks employees Ryan Mackey and Kyle Tapply to be deposed prior to February 23, 2023. Defendants shall prioritize and produce all discovery to Plaintiffs as to these two individuals by the end of January 2023.” 

The plaintiffs including Pierce Robertson, Sanford Gold, Rachel Gold, non-party Eric Rares, and other aggrieved Voyager customers represented by Attorney Adam Moskowitz filed this class action lawsuit against Cuban in August 2022.

They claimed that the deep-pocketed investor promoted the collapsed crypto broker to fans of his NBA basketball team, the Dallas Mavericks. A follow-up claim is that those who invested in Voyager through Cuban’s promotions suffered huge losses. The civil lawsuit seeks to make the Cuban and co-defendants take responsibility for the $5 billion in investor losses.

Part of the complaint read, “Mark Cuban recently spoke at a Dallas Mavericks press conference, conducted over the internet, where he strongly supported and touted the partnership between his company and the Voyager Defendants. Mr. Cuban proudly described how he would personally help significantly increase [the] scope and presence of the Deceptive Voyager Platform for those with limited funds and experience.”

In a new interview with the Street, Cuban said he believes that the next implosion in the crypto ecosystem will originate from the discovery and removal of wash trades on centralized exchanges.

Mark Cuban noted:

“I think the next possible implosion is the discovery and removal of wash trades on central exchanges. There are supposedly tens of millions of dollars in trades and liquidity for tokens that have very little utilization. I don’t see how they can be that liquid.”

What is Wash Trade? Wash trade is a form of market manipulation in which an investor concurrently sells and buys the same assets to create misleading. This is often practiced in the crypto market as a means to pump and dump a particular digital asset.

The Street also reported that Cuban said he does not have specifics to back his prediction.

According to a recent study conducted by the National Bureau for Economic Research (NBER), which involved 29 crypto exchanges, 70% of the volume on unregulated exchanges is wash trading.

Benford’s Law, a statistical benchmark for fraud detection, was used by these researchers to analyze trading data from these exchanges.

The Conclusion of the research read in part:

“We estimate the average wash trading to be 53.4% of trading on unregulated Tier-1
exchanges and 81.8% on Tier-2 exchanges and provide several robustness and validation
tests.

“We further provide suggestive evidence that wash trading inflates exchange rankings and cryptocurrency prices, in addition to being significantly predicted by market signals such as past cryptocurrency prices and volatility and exchange characteristics such as exchange age and userbase.

“As the first comprehensive study of the pervasive crypto wash trading, our paper not only provides a cautionary tale to regulators around the globe but also reminds the readers of the disciplining or screening effects of regulation in emerging industries, the importance of using wash-trading-adjusted volume in certain empirical studies, and the utility of statistical tools and behavioral benchmarks for forensic finance and fraud detection.”

Although he mentioned no precise price range, several TA experts including Crypto Capo speculate that the leading crypto by market capitulation would go as low as $14,000 while others are predicting BTC to touch the $12,000 zone because it rebounds. 

Billionaire Mark Cuban remarked in the podcast, “I want Bitcoin to go down a lot further so I can buy some more.” According to him, Bitcoin is a store of value just like gold. He said, “If you have gold, you’re dumb… No, it’s not a hedge against anything, right? What it is is a store of value and you don’t own the physical gold, do you? Gold is a store of value and so is Bitcoin.”

“You don’t own the gold bar, and if everything went to hell in a handbasket and you had a gold bar, you know what would happen? Someone would beat… you or kill you and take your gold bar. What are you going to shave a little piece of gold so someone weighs it? It’s useless.”

It is worth noting that there have been several crypto project meltdowns including the May collapse of Do Kwon’s stablecoin and the Terra blockchain native token, formerly known as TerraUSD (UST) and LUNA respectively, and the FTX exchange implosion which happened in November. 

While these actions have fueled doubts and reduced trust in the nascent space from some individuals, Mark Cuban expressed his full support for cryptocurrency. He said, “these blowups have not been crypto blowups, they have been banking blowups. Lending to the wrong entity, misvaluations of collateral, arrogant arbs, followed by depositor runs. See Long Term Capital, Savings and Loan, and Sub-Prime blowups. All different versions of the same story.”

While many other players in the industry like Justin Sun have criticized the Ethereum blockchain PoS transition, Mark Cuban has counted himself among the supporters of the Merge upgrade.

In an interview with Fortune, the billionaire noted that he is a fan of the upcoming development, adding that he is super bullish on ETH.

Earlier this month, Justin Sun noted that proof-of-work (PoW) is still essential in the crypto industry as there are surplus PoS blockchain platforms.

In the same vein, a post-Merge Ethereum fork led by Chandler Guo, a popular Chinese crypto miner is being planned. The Tron founder along with many crypto exchanges has announced support for this miner-led fork.

However, Mark Cuban commented saying, “I’m a fan of the Merge, I think the energy usage issue is important.” Beyond marking the end of mining on the largest smart contract platform and taking up a consensus mechanism that will support crypto staking, the Ethereum blockchain will be ecologically friendly. 

It is said that Ethereum’s overall energy consumption will decline by 99.9% after the Merge. However, the upgrade does not guarantee a reduction in gas fees and it may not considerably impact the transaction speed. The Merge will rather set the stage for other upgrades that will make Ethereum more scalable, complete, and less expensive to use.

Therefore, Cuban sees Ethereum’s move to proof-of-stake as a positive development for the blockchain and its native token. “But it’s long term. I don’t [know] if and when it goes up,” he said. “I think the applications to drive usage will be there,” Cuban added. 

Although ETH has been on a downtrend in the past few days, the crypto investor remains bullish on the second-largest crypto by market capitalization. At the time of writing, ETH is trading for $1,663.62 showing a price decline of over 4% in the past 7 days, according to Coinmarketcap data.

The Merge Looks Set 

It is worth noting that the stage was set for the Ethereum network to transition from PoW to PoS two years ago following the launch of the Beacon Chain. “I still think Dogecoin has more applications potentially available to it than Cardano. The opportunity for Cardano was greater until DOGEcoin really becomes a platform for applications, Mark Cuban commented. Cardano (ADA) is the 7th largest crypto by market capitalization while Dogecoin (DOGE) is the 11th largest crypto at the time of writing. 

This statement further reiterates Mark Cuban’s strong support for the leading dog-themed token. The famous billionaire and entrepreneur has always been a supporter of DOGEcoin alongside the Tesla CEO, Elon Musk.

Elon Musk recently said that the capability of Dogecoin in terms of transactions is much higher than that of Bitcoin (BTC), the largest cryptocurrency by market capitalization.

Cuban’s opinion has been met with several disagreements from members of the Cardano community. First, Charles Hoskinson, the face of Cardano (ADA) made a tweet, displaying mockery in response.

Speaking on Ethereum, the founding member of the first commercial streaming company, noted that the various applications of the Ethereum blockchain in niches like decentralized finance (DeFi) and non-fungible token (NFT) over the years are what made Ethereum valuable.

Nobody needs gold jewelry. People like gold jewelry and want it, but they don’t need it. So there’s a utility issue with Bitcoin but, that said, like gold, it’s a good store of value.

“It’s a better store of value when you’re trying to be diverse in your portfolio, and that’s why I own it. Because I think even though I have no idea where it’ll go, I have no idea how low it will go, but I do know that once there are applications with smart contracts not on Bitcoin but across crypto that regular people use and figure out, just like streaming was a better version of getting audio and video than traditional media was when there’s better reason to use crypto applications, that’s when it takes off.

“I always analogize Bitcoin as it’s a better version of gold. It’s a digital version of gold and I truly believe that.”
