<p>The regulation was published on September 5, 2025. It came into effect retroactively from January 1, 2025, and runs through December 31, 2029. That means Thailand has been operating under this policy for the better part of two years.</p>

<h2><strong>What the Regulation Does</strong></h2>
<p>The Thai Ministry of Finance issued the regulation under the Revenue Code. It exempts individual investors from personal income tax on capital gains earned through the sale of cryptocurrencies and digital tokens. The exemption applies only to trades executed through exchanges, brokers, or dealers licensed by Thailand&#8217;s Securities and Exchange Commission.</p>
<p>Previously, those gains were taxable as ordinary income at rates up to 35%. Mining, staking, and airdrop income remain taxable. The exemption covers individuals only. Companies do not qualify.</p>
<p>XRP produced the <a href="https://timestabloid.com/big-news-for-xrp-holders-from-thailand/">highest returns of any asset class in Thailand last year</a>, and the stated goal is to position itself as a regional digital asset hub. The policy aims to pull trading activity onto domestic, regulated platforms and increase transparency across the sector.</p>
<h2><strong>The U.S. Has Not Followed</strong></h2>
<p>The contrast with the U.S. is significant. The CLARITY Act, which would establish a comprehensive regulatory framework for digital assets, <a href="https://timestabloid.com/clarity-act-update-for-xrp-holders-elizabeth-warren-drops-major-statement/">remains stalled in Congress</a>. It has not received a floor vote and risks dying in committee before the legislative recess.</p>
<p>No capital gains exemption for crypto has passed at the federal level. Coinbase&#8217;s VP of Tax testified before Congress in February 2026, warning that applying capital gains rules to everyday crypto transactions <a href="https://timestabloid.com/coinbase-urges-congress-to-scrap-capital-gains-taxes-on-bitcoin-xrp-others/">would overwhelm both taxpayers and the IRS</a>. He pushed for a de minimis exemption on small transactions. That request has not yet produced legislation.</p>

<h2><strong>The Gap Widens</strong></h2>
<p>Thailand is not alone in its approach. Singapore, the UAE, and Malaysia have each established favorable tax environments for individual crypto investors. The regulatory momentum in Asia is real and documented. The U.S. crypto industry continues to lobby for change. But while that lobbying continues, other countries are writing policy into law.</p>

<p>In a post on X, SMQKE wrote, “Yes, Ripple facilitates real-time blockchain-based payments between Thailand and Japan,” before illustrating the payment flow as Japanese yen (JPY) moving through XRP before being converted into Thai baht (THB).</p>

<p>As consumers will no longer have access to make payments for goods and services in cryptocurrencies from 1st April, businesses have 30 days from the date announced to completely remove Bitcoin and other cryptocurrencies as payment options.</p>
<p>Also, the directive will deter crypto businesses from promoting crypto payments.</p>
<p>The translated Thailand SEC’s order reads in part:</p>
<p><em>“The SEC issues rules for providing services to digital asset operators In order not to support or promote the use of digital assets as a means of payment for goods and services (Means of Payment) in order to prevent impacts on financial stability and the national economy, according to the BOT and the SEC The police had discussed and saw the need for supervision. For digital asset business operators that have already provided services Must comply with the rules within 30 days from 1 April 2022.”</em></p>
<p>According to the SEC, it’s exercising its powers in accordance with the relevant legal framework.</p>
<p>It’s clear that cryptocurrency has not been totally banned in the country. The SEC says its ruling is only meant to supervise the services of business operators and make sure they are not using digital assets as a medium for payment of goods and services.</p>
<p><em>“The SEC has therefore considered exercising its powers in accordance with the relevant legal framework. To supervise the services of business operators not to use digital assets as a medium for payment of goods and services,”</em> the regulator added.</p>

<p>It can be recalled that the crypto industry took a positive stance towards Thailand, which led to the SEC backtracking its plan for a 15% tax on crypto assets following tons of backlashes from the public.</p>
<p>Meanwhile, the Southern Asian nation banned the trading of meme coins, non-fungible tokens (NFTs), and social tokens, back in 2021.</p>
