While U.S. lawmakers continue debating the future of crypto regulation, at least one country has already moved. Thailand formalized a 0% capital gains tax on cryptocurrency trades back in September 2025.

Crypto commentator Xaif (@Xaif_Crypto) recently highlighted this. He shared images of the official Thai Royal Gazette document to make the point.

The regulation was published on September 5, 2025. It came into effect retroactively from January 1, 2025, and runs through December 31, 2029. That means Thailand has been operating under this policy for the better part of two years.

What the Regulation Does

The Thai Ministry of Finance issued the regulation under the Revenue Code. It exempts individual investors from personal income tax on capital gains earned through the sale of cryptocurrencies and digital tokens. The exemption applies only to trades executed through exchanges, brokers, or dealers licensed by Thailand’s Securities and Exchange Commission.

Previously, those gains were taxable as ordinary income at rates up to 35%. Mining, staking, and airdrop income remain taxable. The exemption covers individuals only. Companies do not qualify.

XRP produced the highest returns of any asset class in Thailand last year, and the stated goal is to position itself as a regional digital asset hub. The policy aims to pull trading activity onto domestic, regulated platforms and increase transparency across the sector.

The U.S. Has Not Followed

The contrast with the U.S. is significant. The CLARITY Act, which would establish a comprehensive regulatory framework for digital assets, remains stalled in Congress. It has not received a floor vote and risks dying in committee before the legislative recess.

No capital gains exemption for crypto has passed at the federal level. Coinbase’s VP of Tax testified before Congress in February 2026, warning that applying capital gains rules to everyday crypto transactions would overwhelm both taxpayers and the IRS. He pushed for a de minimis exemption on small transactions. That request has not yet produced legislation.

Eric Trump signaled administration support for exempting U.S.-based crypto projects from capital gains tax as far back as January 2025. That proposal also has not advanced into law.

The Gap Widens

Thailand is not alone in its approach. Singapore, the UAE, and Malaysia have each established favorable tax environments for individual crypto investors. The regulatory momentum in Asia is real and documented. The U.S. crypto industry continues to lobby for change. But while that lobbying continues, other countries are writing policy into law.

Thailand’s plans for a baht-backed stablecoin have prompted fresh comparisons with payment systems that are already operating across its financial sector.

Crypto researcher SMQKE pointed to Ripple’s documented role in enabling real-time cross-border payments between Japan and Thailand, sharing evidence that the company’s blockchain infrastructure has already been used to reduce international transfer times from days to seconds.

In a post on X, SMQKE wrote, “Yes, Ripple facilitates real-time blockchain-based payments between Thailand and Japan,” before illustrating the payment flow as Japanese yen (JPY) moving through XRP before being converted into Thai baht (THB).

To support the claim, SMQKE attached a presentation slide outlining Ripple’s collaborations with major financial institutions and highlighting a case study involving Siam Commercial Bank (SCB) of Thailand and SBI Remit.

Presentation Highlights Ripple’s Previous Partnership With SCB

The attached document describes Ripple’s partnership history with several international financial institutions, including Bank of America, Standard Chartered, Santander, UBS, Westpac, MUFG, BBVA, Axis Bank, and others. However, the presentation’s primary focus was Ripple’s collaboration with SCB and Japan-based SBI Remit.

According to the slide, Ripple’s technology enabled individual fund transfers from Japan to Thailand by allowing Japanese yen to be transferred into Thai baht deposits held in SCB savings accounts. The presentation stated that the implementation reduced settlement times from approximately two business days to between two and five seconds.

The document also included a statement attributed to SCB Chief Strategy Officer Dr. Arak Sutivong, who said the bank was proud to become the first institution to use Ripple’s blockchain network for real-time payments between Japan and Thailand. The statement added that SCB intended to continue working with Ripple while expanding the service into additional markets.

CoinDesk Report Adds Fresh Context

SMQKE shared the presentation while referencing a CoinDesk report saying, “JUST IN: Thailand’s central bank announces a Baht-backed stablecoin for interbank settlement, with public consultation starting before year-end.”

Although the researcher did not claim that Ripple is directly involved in the proposed stablecoin initiative, the post suggested that Ripple’s documented payment corridor between Japan and Thailand demonstrates the company’s established role in the country’s cross-border payments landscape.

Community Response Focuses on XRP Price Performance

As recently announced by Thailand’s Securities and Exchange Commission (SEC), cryptocurrency payments will be banned in the country starting 1st April 2021.

According to the report, the SEC based its decision on the highly volatile crypto markets, lack of customer protection, money laundering, and cyber theft risks.

As consumers will no longer have access to make payments for goods and services in cryptocurrencies from 1st April, businesses have 30 days from the date announced to completely remove Bitcoin and other cryptocurrencies as payment options.

Also, the directive will deter crypto businesses from promoting crypto payments.

The translated Thailand SEC’s order reads in part:

“The SEC issues rules for providing services to digital asset operators In order not to support or promote the use of digital assets as a means of payment for goods and services (Means of Payment) in order to prevent impacts on financial stability and the national economy, according to the BOT and the SEC The police had discussed and saw the need for supervision. For digital asset business operators that have already provided services Must comply with the rules within 30 days from 1 April 2022.”

According to the SEC, it’s exercising its powers in accordance with the relevant legal framework.

It’s clear that cryptocurrency has not been totally banned in the country. The SEC says its ruling is only meant to supervise the services of business operators and make sure they are not using digital assets as a medium for payment of goods and services.

“The SEC has therefore considered exercising its powers in accordance with the relevant legal framework. To supervise the services of business operators not to use digital assets as a medium for payment of goods and services,” the regulator added.

It can be recalled that the crypto industry took a positive stance towards Thailand, which led to the SEC backtracking its plan for a 15% tax on crypto assets following tons of backlashes from the public.

Meanwhile, the Southern Asian nation banned the trading of meme coins, non-fungible tokens (NFTs), and social tokens, back in 2021.
