With 51 Votes Confirmed Out of 60, XRP Pundit Explains Why Clarity Act Can Pass In August

Software engineer and crypto analyst Vincent Van Code (@vincent_vancode) has updated his CLARITY Act vote tracking. His previous analysis revealed that the bill had 51 confirmed votes against 60, the threshold.

With Senate recess approaching, the consensus among observers hardened quickly around that gap, and many concluded that the bill would not pass. However, that conclusion skips a critical number buried in the same analysis.

What the Democratic Breakdown Shows

Van Code’s tracking shows that only 12 out of 45 Senate Democrats have openly declared opposition to the bill. The remaining 33 have made no public statement either way. The bill does not need to convert anyone who has already said no. It needs 9 votes from a pool of 33 senators who have stayed completely silent. That is the number the pessimistic read is not accounting for.

The Vocal Opposition

The 12 who opposed the bill make the most noise. Senator Elizabeth Warren voted no in the May committee markup. She also proposed multiple harmful amendments, and has consistently characterized the legislation as written for the industry.

Seven Democrats, including Senators Ruben Gallego and Angela Alsobrooks, signed a joint statement on July 22 declaring the current text falls short on ethics, consumer protection, and market integrity.

Alsobrooks, who helped broker the stablecoin yield compromise that got the bill out of committee in May, specifically rejected the latest draft and called the DOJ-only ethics enforcement “an unserious offer.” Those are loud voices, but they do not represent the majority of the Democratic caucus.

A Wide Pool of Potential Yes Votes

Van Code assesses that the 33 uncommitted Democrats tend to be younger, less tied to traditional banking interests, and more directly accountable to their constituencies. That accountability has a factual foundation.

60 million Americans currently hold crypto, making it one of the largest single interest groups in U.S. political history. Senators representing states with significant crypto-holding populations face real electoral pressure to reflect that constituency in their vote.

The Fact-Based Case

Van Code is not American and holds only a small personal financial position in the space. He is applying over 30 years of trading experience across multiple asset classes to what he views as a straightforward analytical observation rather than an emotional one.

His assessment is that XRP, XLM, ADA, ETH, and SOL are grossly undervalued, with regulatory uncertainty as the primary suppressing factor. The CLARITY Act directly addresses that uncertainty. He is not offering financial advice, but making the case that separating observable facts from emotional reaction produces accurate analysis.

In his view, the analysts calling this bill dead are working almost entirely from the 12 Democrats who spoke loudly, and missing the bigger picture.

The Bill Still Has a Chance

Majority Leader Thune committed to a floor vote and told reporters it is coming soon. A revised draft was released on July 22 and includes an ethics provision, and negotiations remain active. The recess deadline is coming, but 33 Democratic senators have not spoken, and the bill needs only 9 of them, suggesting that the bill has a good chance.
