The SEC Moves First

SEC Chairman Paul Atkins had already made his position clear before the vote. He promised to act within the SEC’s statutory authority with or without legislation, and he delivered. On August 18, the SEC proposed Regulation Crypto Assets, a new offering framework with two registration exemptions for crypto investment contracts.

On September 1, the commission followed with a comprehensive overhaul of transfer agent rules, the first since the 1970s. The updated rules expressly permit transfer agents to use blockchain and distributed ledger technology to maintain securities ownership records. The proposal introduces new reporting requirements on DLT usage and tokenized securities activity.

On September 17, two days after the failed vote, the SEC issued the Innovation Exemption. It grants five-year relief for participants facilitating trading of tokenized NMS stocks through automated market makers on public blockchains. The exemption runs until September 17, 2031.

The CFTC Follows

CFTC Chairman Michael Selig said on the day of the Senate vote his agency was “locked in and ready to ship rules.” The CFTC acted quickly. On September 17, it submitted Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets to the White House Office of Information and Regulatory Affairs under RIN 3038-AF80.

The same day, it issued Staff Letter 26-25, expanding no-action relief for passive software providers across the entire industry, beyond the single firm that previously held it.

Wall Street veteran analyst Rob Cunningham has presented a thesis on X that places Japan at the center of a potential shift in global currency, collateral, and settlement infrastructure. His analysis questions whether Japan’s involvement with XRP goes beyond investment and reflects years of preparation for changes in the financial system.

“Did Japan merely invest in XRP – or did Japan quietly build the monetary shock absorbers needed to navigate the greatest collateral, currency and settlement transition in modern history?” Cunningham wrote.

He connects the thesis to Japan’s management of the yen carry trade and the possibility that the country could repatriate part of its large foreign-asset holdings. Cunningham believes such a move could coincide with stronger demand for U.S. Treasuries through dollar stablecoins that comply with the GENIUS Act framework.

SBI’s Role In Ripple’s Ecosystem

Cunningham points to SBI’s involvement in real-time payments, international remittances, digital-asset custody and trading, XRP shareholder rewards, corporate XRP treasury adoption, tokenization initiatives and XRPL development.

He says this gives Japan significant institutional options involving Ripple, XRP and the XRP Ledger.

Cunningham also separates SBI’s exposure to Ripple from simply holding XRP. He notes that SBI owns 9% of Ripple and says this represents an ownership interest in the company’s wider enterprise.

“SBI’s economic exposure is also broader than the market value of XRP alone,” Cunningham wrote.

Cunningham then presents a six-step structure for how he believes a yen carry trade unwind could interact with the financial system.

The first step involves revaluing gold to market prices to absorb confidence risk. The second uses 50-year Treasury Trust Bonds to address duration risk. He then proposes Treasury facilities and lower interest rates to absorb market risk.

Stablecoins form the fourth step. Cunningham says they could absorb short-term Treasury issuance. XRP represents the fifth component, with a higher XRP price potentially reducing settlement friction.

The final step involves coordination between the different participants.

He concludes that Japan may occupy two positions during this potential transition. The country could unwind parts of the existing dollar carry trade structure while already possessing financial infrastructure designed around faster digital-value settlement.

Lummis’ 2030 Warning

The warning is not new, but the timing gives it more weight. The Senate cloture vote on the CLARITY Act is scheduled for September 15 at 2 p.m. That vote requires 60 votes to advance the bill. All 53 Senate Republicans are committed to voting yes, but 7 Democratic votes are still needed.

If the bill fails to clear cloture, it does not simply get rescheduled. The 2026 midterm election calendar leaves almost no legislative floor time after September. A new Congress takes over in January with an unknown composition. The bill would restart from zero. Lummis believes that process would not produce results until 2030.

The House Calendar Problem

Even if the Senate clears cloture on September 15, a separate timing problem exists. The House of Representatives canceled the final two weeks of its September session. Members leave Washington by September 17. That leaves a two-day overlap between the Senate vote and the House departure.

If the Senate passes an amended version of the bill, the House must approve those changes before it can go to the President. With members absent until mid-November, any Senate amendments could stall the bill even after a successful vote.

BIS Reference Highlights Importance of Documentation

Vet also used a recent working paper from the Bank for International Settlements (BIS) to demonstrate why XRPL.org’s documentation matters. He pointed to the paper’s reference to XRPL.org for documentation and developer resources concerning the XRP Ledger.

He said institutions, governments, banks, nonprofits, and other organizations can use the website when they need factual and technical information about the network. Vet described XRPL.org as the reference point for documentation when outside organizations research or discuss the XRP Ledger.

He also mentioned a Google Quantum paper as another example of research that references information from the ecosystem’s official documentation.

New Structure Covers XRPL Development and Use Cases

The redesigned site includes sections covering payments, tokenization, trading, the decentralized exchange, automated market makers, non-fungible tokens and stablecoins.
