The Bill’s Security-by-Default Structure

Under the bill, all new digital assets start as securities by default. To escape that classification, a project must petition the SEC and prove its blockchain qualifies as a “mature blockchain system,” meaning it is sufficiently decentralized and no longer reliant on the issuer’s ongoing efforts.

Ripple’s Financial Independence

Hoskinson emphasized that Ripple had significant resources to manage the SEC case independently. “The Ripple organization gave itself a mammoth pre-mine. That’s a fact. It’s like tens of billions of dollars now that they have access to. They didn’t need any money,” he said.

He compared Ripple to other projects such as EOS, which allocated $4 billion to itself in 2017. Hoskinson highlighted that Cardano, by contrast, did not allocate 70% of its supply to founders.

Funding and Revenue

Hoskinson questioned the origins of Ripple’s funding for major initiatives. He asked where Ripple secured the funding to acquire Hidden Road for $1.25 billion. He also drew attention to the revenue from RLUSD, the stablecoin the company launched in late 2024.

He pointed out that standard subscription models alone could not generate the scale of these projects. His remarks show that Ripple kept XRP to fund its operations rather than giving the tokens out to the public.

Hoskinson’s Selective Focus

Digital Asset Investor noted that while Hoskinson critiqued the XRP community, he did not address Ethereum’s ICO and its funding model. He is publicly criticizing Ripple’s actions, but just like the SEC did, he has not called out Ethereum, which did a similar thing through its ICO.

This omission is crucial because Ethereum also had substantial pre-mined allocations. This raised questions about the balance of Hoskinson’s critique, even as he acknowledged past engagement with Ripple executives and expressed willingness to collaborate with the company.

Challenges for the Broader Crypto Industry

Despite these exceptions, Hoskinson emphasized that the bill presents serious challenges for the broader crypto ecosystem. He mentioned that many decentralized finance protocols and stablecoin projects receive no specific protections. He noted, “There’s nothing in this for DeFi. Nothing. Uniswap doesn’t get anything. Prediction markets don’t get anything. Armstrong can’t even get his yield-bearing stablecoins.”

This refers to Coinbase CEO Brian Armstrong withdrawing support for the CLARITY Act. Armstrong pulled support because the bill’s stablecoin-related language would limit certain yield‑bearing stablecoin mechanisms, which Coinbase views as essential for how platforms compete and offer services.

Hoskinson also criticized the bill’s overall approach, saying, “This is not a good bill.” He said the legislation could create regulatory hurdles for future projects, even as it provides clarity for networks like XRP and Cardano.

Some experts believe the CLARITY Act will benefit XRP, and Hoskinson acknowledged that some aspects could help legacy networks. However, his remarks highlight potential risks for innovation and adoption in other sectors of the crypto industry.

The CLARITY Act designs clearer rules for digital assets in the U.S. It clarifies when a cryptocurrency qualifies as a security or a commodity and assigns regulatory authority between the SEC and CFTC. The bill passed the House of Representatives in 2025 and is currently under review in the Senate. Its goal is to create a legal framework that provides clarity for institutional investors, banks, and blockchain projects.

Brad Garlinghouse, CEO of Ripple, has expressed confidence in the legislation’s passage. He estimates a 90% chance that the CLARITY Act will be enacted by April 2026. However, with major industry stakeholders standing against it, it could face hurdles.
