The Senate is targeting September 15 for initial action on the CLARITY Act. The Schedule Conflict
House members are now expected to leave Washington on or before September 17. They are not scheduled to return until mid-November. That two-day gap between the Senate’s September 15 start and the House’s September 17 departure is the crux of the timing concern.
The Senate cloture vote on September 15 is the start. After clearing the 60-vote threshold, the Senate enters a debate period, an amendment phase, and then a final passage vote. That sequence alone takes time. If the Senate produces a version of the bill that differs from the House-passed text, the House must agree to the final version before it reaches the President’s desk.
What Comes Next?
The Senate can still move forward regardless of the House schedule. Diana acknowledged that the legislation “could ultimately return to the House later.” The more significant variable is timing. A post-election return in mid-November would place any remaining House action in a different political environment, after voters have decided control of Congress.
Senator Tim Scott has publicly stated the bill will become law, identifying September as the strongest window for progress. The CLARITY Act cleared the House in 2025 and advanced through Senate Banking in May. Senate Majority Leader John Thune filed cloture before the Senate left for recess, guaranteeing the bill floor time after resumption.

What This Means for XRP
The CLARITY Act would establish a regulatory framework for digital assets, defining which fall under SEC jurisdiction and which fall under the CFTC. XRP holders have closely tracked the bill’s progress because it will directly impact Ripple and XRP regulation.
A final passage before the election would deliver regulatory clarity sooner. A delay into the post-election period extends the current uncertainty. That is what Diana outlined as the biggest risk. Senator Cynthia Lummis has stated that missing this window could push regulatory clarity to 2030.
