This so-called shorthand constitutes an unconstitutional shortcut taken by the SEC in the XRP lawsuit that violated 76 years of case law, Deaton noted. </span></p>

<p>According to the Crypto Law founder and the attorney representing over 75,000 XRP holders in the Ripple-SEC lawsuit, the regulator has refused to focus on the circumstances surrounding the offering and sale of XRP; instead, it is focusing on the token itself.</p>

Deaton noted that the securities agency currently chaired by Gary Gensler is analytically lazy. </span></p>

<p><span style="font-weight: 400;">John Deaton <a href="https://timestabloid.com/attorney-john-deaton-states-the-single-factor-that-proves-xrp-is-not-a-security/" target="_blank" rel="noopener">restated</a> his confidence in Ripple defeating the SEC in the XRP lawsuit, <a href="https://timestabloid.com/ripple-says-its-more-confident-than-ever-ahead-of-judges-decision-on-xrp-lawsuit/" target="_blank" rel="noopener">expected</a> to be wrapped up in Q2 of 2023. He </span><a href="https://twitter.com/JohnEDeaton1/status/1621359223870210049" target="_blank" rel="noopener"><span style="font-weight: 400;">reiterated</span></a><span style="font-weight: 400;"> that the presiding judge will <a href="https://timestabloid.com/xrp-lawsuit-john-deaton-states-why-sec-motion-for-summary-judgment-would-be-denied/" target="_blank" rel="noopener">deny</a> the SEC&#8217;s summary judgment highlighting two reasons. First, he said the underlying asset (XRP in this case) is never a security in an investment contract case. Secondly, he mentioned that the Howey test requires analysis at the time of each offer or sale which is something the SEC failed to do. </span></p>
<p><span style="font-weight: 400;">Additionally, the lawyer highlighted the significance of the latest ruling recently given in the SEC v LBRY case. The judge ruled that LBC tokens sold in secondary markets do not constitute a security.</span></p>

<p>According to the journalist named Eleanor Terrett, the SEC commissioner, Hester Peirce has privately stated that she thinks the SEC will eventually lose the case against Ripple.</p>
<p>Eleanor said she got the information from a source close to the U.S. regulator.</p>

<h2><strong>All Indications Point at Ripple Winning the Case</strong></h2>
<p>Ripple CEO Brad Garlinghouse, in an interview with Fox Business, <a href="https://timestabloid.com/rumors-spreading-that-ripple-sec-lawsuit-has-ended-in-settlement-ripple-ceos-comments-give-hints/" target="_blank" rel="noopener">said</a> the SEC Chairman, Gary Gensler revealed that the regulatory agency will lose some of its cases.</p>
<p>Although it’s not yet clear whether he’s referring to the SEC’s case with Ripple, there is a possibility that he was talking about the blockchain-based payment firm.</p>

<p>It’s worth noting that SEC Commissioner Hester Pierce has been speaking up since the start of the lawsuit, calling for the regulation of the fast-growing market. Howbeit, all her efforts proved abortive.</p>
<p>As things start to seemingly go in favor of Ripple, Many believe that the firm could use a lack of regulatory clarity for crypto assets against the SEC during the upcoming Fair Notice Defense.</p>
