The CLARITY Act will likely not get a Senate vote before the August recess. Former Fox Business journalist Eleanor Terrett reported that “The Senate has decided to punt a vote on the Clarity Act until September, per Politico.”
Politico congressional reporter Jordain Carney confirmed that Senate Majority Leader John Thune himself verified the delay, adding that leadership plans to have the bill “teed up for when they return.” This report comes shortly after multiple senators suggested they would stay longer to ensure the vote plays out.
Senators Wanted a Vote
Senator Cynthia Lummis had said the Senate would work into the weekend to get votes done before recess. Senator John Kennedy went further. He warned that if the Senate left without a positive vote, “the odds shift against us.” Both senators urged action but neither got it.
Senator Elizabeth Warren had already signaled the bill was stuck. She said Congress had still not solved its problems, citing corruption, consumer protection, national security, and economic protection. Her position proved accurate about the timeline, if not the reasoning leadership cited.

The Current Dispute
The CLARITY Act needs 60 votes to pass. It currently has 51 confirmed votes, with up to 10 Democrats expressing support. Most ethics problems have been solved. The central dispute remains whether state attorneys general should have authority to sue the Department of Justice over ethics enforcement.
Republicans and the White House are against that provision. Senators Tom Tillis and Ruben Gallego pushed for negotiations on that provision, but no agreement came.
September Is the Next Window
Thune’s confirmation means the bill has a target window when the Senate returns. That is not a guarantee of passage. It is a scheduling commitment. The 2026 midterm election cycle compresses available floor time after recess, and a new Senate could restart or alter the process entirely.

Senator Cynthia Lummis previously predicted that missing the current window could push proper crypto legislation as far as 2030. After prolonged and heated negotiations, it seems the bill will not pass as she and many others hoped.
Can Trump Force a Vote?
One question circulating in the XRP community asks whether President Trump could legally compel the Senate to remain in session and vote on the bill. Meta Law Man, a well-known attorney in the crypto space, confirmed that Trump does have the legal authority to cancel the August recess.
However, no reports indicate the president intends to exercise that power. Until Trump signals otherwise, the September timeline stands as the next realistic opportunity for a CLARITY Act vote.
