A senior Democratic senator has gone on record about his frustrations with the CLARITY Act negotiations. He wants it passed, but he wants it passed right.
Warner Speaks During Treasury Hearing
During a Senate Finance Committee hearing on July 16, Francis Brooke testified as a nominee for Deputy Secretary of the Treasury. Warner used the moment to speak about his stance on the CLARITY Act.
“I am tired of being in crypto hell,” Warner said. He made clear that his frustration is not with the legislation itself, but with the conditions surrounding it. “I want America to lead in digital assets,” he said, adding that getting it wrong carries serious consequences.

The Importance of Warner’s Vote
The CLARITY Act needs 60 votes to clear the Senate floor. Republicans hold a slim majority, which means Democratic crossover votes are not optional. Warner is one of the Democrats the bill’s supporters are watching most closely. His willingness to engage, even while expressing reservations, keeps the door open. If he votes yes, it signals to other Democrats that a deal is reachable. His vote could move others.
Most Senate Democrats have withheld support over ethics provisions. The pressure is mounting as the chances of the bill passing this year have lowered. The Democrats want enforceable rules preventing the president, members of Congress, and their families from holding or profiting from crypto assets while in office. The current draft does not satisfy that demand.
Trump’s Crypto Income Sits at the Center
The ethics dispute ties directly to President Trump’s financial disclosures. A 927-page filing released July 1 by the Office of Government Ethics revealed that Trump’s total crypto-related income for 2025 reached approximately $1.4 billion.

Democrats pointed to those figures and refused to advance the bill without language targeting the president’s personal holdings. The White House has rejected that condition. That standoff is the reason the bill remains stalled, and Senator Elizabeth Warren demanded that Trump voluntarily disclose his crypto earnings for the first half of 2026 by July 23.
The Window Is Closing
The Senate breaks for recess on August 11. If the CLARITY Act does not pass before then, it faces a significantly longer and more uncertain path. Warner’s comments suggest he remains a potential yes vote. Getting there requires a deal on ethics. That deal does not yet exist.
