Update for XRP Holders: These Two Senators Says CLARITY Act Is Not Dead

The Clarity Act failed to advance in the U.S. Senate on Tuesday after lawmakers could not secure the 60 votes required to move the legislation forward. The procedural vote ended 49-50, leaving the digital asset market structure bill stalled after months of negotiations between Republicans and Democrats.

The result immediately raised questions about whether the legislation has reached the end of its path in the current Congress. Former Fox Business journalist Eleanor Terrett updated followers on X after speaking with two Republican senators, John Kennedy of Louisiana and Ted Cruz of Texas, who offered different explanations for the setback while leaving open the possibility of another attempt.

According to Terrett’s tweet, Kennedy said he “wasn’t surprised” that the Clarity Act vote failed. However, he does not believe the bill is necessarily dead.

Kennedy Points to a Potential Lame-Duck Return

Terrett reported that Kennedy believes Democrats understand the need for a cryptocurrency market structure that is deliberately designed and clearly defined. He said the legislation may have to wait until the lame-duck session.

“I think my Democratic colleagues understand that we need to design a market structure for cryptocurrency that looks like somebody designed it on purpose,” Kennedy told Terrett. “But it’s gonna have to wait until the lame duck session.”

The senator’s comments indicate that he sees the failed vote as a delay rather than an absolute end to the legislation. However, any attempt to revive the measure during the lame-duck period would still face significant procedural and legislative requirements.

One commenter, Malhar Oza, noted that a lame-duck effort would still require action from the House. He said the House would need to pass the Senate’s text word for word, while legislation not enacted before January 3 would expire with the current Congress.

Cruz Blames Democrats for the Setback

Cruz offered a more direct assessment of Tuesday’s outcome. Terrett reported that the Texas senator referenced The Princess Bride while describing the bill’s status.

“There’s a big difference between dead and mostly dead. I hope it comes back to life,” Cruz said.

He also blamed Democrats for the failure, accusing them of “playing politics” and pushing cryptocurrency activity and jobs overseas.

The comments came as Democrats continued to raise objections to provisions in the legislation, particularly issues involving ethics and digital asset activity by government officials. Republican supporters released revisions before the vote to address some of those concerns, but the changes did not produce the 60 votes needed to proceed.

Questions Remain Over What Comes Next

The failed vote was procedural, not a final vote on whether the Clarity Act should become law. The Senate did not begin full consideration of the legislation after the motion to proceed failed.

While commenter Jared Langel raised the possibility of future regulatory action involving the SEC and CFTC, another X user questioned why the United States still lacks comprehensive federal cryptocurrency legislation despite its large digital asset market.

For now, Kennedy’s comments leave open the possibility of a renewed legislative effort during the lame-duck session, while Cruz expressed hope that lawmakers could bring the bill back. The immediate result, however, is that the Clarity Act remains stalled after Tuesday’s Senate vote.
