Senator Bernie Moreno has shared a clear message for anyone suggesting the CLARITY Act still needs work before it reaches a Senate vote. There is nothing left to negotiate. Moreno made that position explicit in a public statement responding to reports of unresolved issues surrounding the bill.
The Reported Issues With the Bill
Former Fox Business journalist Eleanor Terrett had reported two outstanding disputes. The first centers on yield language. She claimed that banks have lobbied several Republican senators to change how the bill addresses the issue.
The second involves an ethics provision. Democrats want state attorneys general to hold the power to take legal action against the DOJ over ethics enforcement. Republicans and the White House oppose that position. Moreno rejected the claims entirely.

Moreno’s Objection
“There is absolutely nothing to ‘iron out,’” he said. He stated that an agreement was reached weeks ago and that all parties to that agreement “will be expected to keep their commitments.”
He also declared that 11 months of negotiations between Senate Republicans and Democrats “have officially ended,” echoing Senator Cynthia Lummis’s sentiment that negotiations are over and the bill is ready. Every senator will now have the opportunity to vote.
Moreno’s statement on the vote count has also caught many by surprise. Previous reports stated that the bill had 51 confirmed votes. Moreno expressed confidence that “ALL 53 Senate Republicans will vote in favor of ending debate (cloture) on the consideration of this extremely important piece of legislation.” That confirms full Republican unity behind the bill heading into September.
The Date Is Set
Moreno named September 15, 2026, at 2:15 PM as the time for the cloture vote on the motion to proceed. XRP holders and the broader market are eagerly anticipating the vote. Senate Majority Leader John Thune had already filed cloture before lawmakers left for the August recess. The filing guaranteed the bill floor time when the Senate returns.

Moreno’s statement now puts a specific date and time on the record. The bill needs 60 votes to advance past the cloture threshold. With 53 Republican votes confirmed, the bill requires at least 7 Democrats to cross over.
The Choice for Democrats
Moreno addressed Senate Democrats directly. He said they face a choice between handing the industry to China or embracing American innovation. “It’s an easy choice if you love America,” he said.
His framing puts Democratic senators on notice. Reports have indicated that between 7 and 10 Democrats are prepared to support the legislation. If those numbers hold, the bill clears the 60-vote threshold.
