Update for XRP Holders: Recent Action Shows No Bipartisan Agreement On CLARITY Act

The U.S. Senate’s final days before the August recess are revealing where priorities stand. Senate Majority Leader John Thune filed cloture on the motion to proceed to the college sports bill.

Former Fox Business journalist Eleanor Terrett posted the update, adding that it signals there is still no bipartisan agreement on the CLARITY Act.

The filing consumes procedural floor time the CLARITY Act needed. The Senate departs for recess on August 8, and every cloture filing narrows what remains available.

Where the CLARITY Act Stands

The CLARITY Act is crypto market structure legislation that would establish a legal framework dividing digital asset oversight between the SEC and CFTC. It needs 60 votes to advance. It currently holds 51 confirmed votes. Reports indicate 7 to 10 Democrats are signaling support, which would push the bill past the threshold.

However, the decision to vote on a different bill suggests that all votes have not been secured. The holdout is an ethics provision. Democrats want accountability built into the bill through state-level legal enforcement against the DOJ. The White House and Republicans have pushed back. Senators Tom Tillis and Ruben Gallego drive the negotiation effort. Their latest compromise proposal remains unanswered at the White House.

A Crowded Senate Calendar

The Senate calendar is working against the bill. Government funding, Russia sanctions, nominations, and now the college sports bill are all competing for floor time. Thune told reporters Monday he plans to keep the Senate in session to finish outstanding business, including a cloture vote on crypto market structure legislation.

For a Thursday vote to happen, Thune needed to file cloture on the CLARITY Act by Tuesday. That window has passed without a filing. However, Senators John Kennedy and Cynthia Lummis have suggested that the Senate could stay longer, with Lummis saying the vote could extend into the weekend.

What Failure to Vote Means

Senator Cynthia Lummis has been explicit about the consequences. She warned that missing this window pushes crypto regulation to 2030. The 2026 midterm election cycle compresses Senate floor time after recess, and a new Congress could force the process to restart entirely.

One community member drew attention to the political risk Thune is taking. The industry has grown into a significant political force, and sidelining the CLARITY Act carries consequences beyond the Senate floor. Floor time and votes remain the outstanding obstacles, and Terrett’s update suggests neither problem is resolved.
