CLARITY Act Update for XRP Holders: Senate’s Official Agenda Is Out. See Details

The U.S. Senate released its official floor schedule for Tuesday, August 4, 2026. Crypto analyst Diana (@InvestWithD) shared the update with her audience. The schedule confirms that the CLARITY Act does not appear on today’s announced agenda.

The Senate Press Gallery published the day’s activity. Senators are focused on a resolution for government funding and executive and judicial nominations. The CLARITY Act, which the crypto community has watched closely for months, is not part of the announced plan.

Diana noted that Senate leadership retains the ability to revise the agenda if negotiations advance.

Where Negotiations Stand

The bill has sat on the Senate Legislative Calendar since June 1. It passed the Senate Banking Committee in May after clearing the House in 2025. The bill needs 60 votes to pass. It currently has 51 confirmed votes, and 7 to 10 Democrats have signaled support, potentially giving it enough votes to cross the threshold.

One dispute continues to hold back a floor vote. Democrats want state attorneys general to have authority to sue the DOJ over ethics enforcement. Republicans and the White House oppose this. Senators Tom Tillis and Ruben Gallego are leading discussions to find a resolution.

Former Fox Business journalist Eleanor Terrett reported that a breakthrough could come within days, but any agreement still requires President Trump’s approval before the bill can advance.

Time Is Running Out

August 7 is the final scheduled Senate workday before the recess. If Senate leadership files a cloture motion on Wednesday, the earliest a procedural vote could occur is Friday. That leaves almost no room before senators leave Washington. Any shortcut would require unanimous consent.

Andy Baehr, Managing Director of Asset Management at GSR, addressed the situation, stating that if cloture does not happen before the August recess, the timeline slides to September. Prediction markets currently place the odds of passage this year at roughly 30%.

Senator Lummis has been explicit about the consequences of a missed window. She warned that failure to pass the bill pushes crypto regulation to 2030.

XRP and the CLARITY Act

XRP stands to benefit from the bill’s passage. The CLARITY Act establishes legal distinctions between digital assets classified as commodities and those classified as securities.

However, many in the community have given up on a vote happening this week. Major institutions have all backed the legislation. The policy case for the bill is not in serious dispute. What remains is floor time and the votes to advance it.
