Chris Giancarlo has seen many regulatory battles up close. As former chairman of the CFTC, he knows Washington’s pace better than most. So when he tells the crypto industry to stop treating the CLARITY Act like a make-or-break moment, many investors pay attention.
Scott Melker, popularly known as The Wolf of All Streets, sat down with Giancarlo for an interview. Melker shared a clip in which Giancarlo discussed the CLARITY Act and the attention it has gotten from market participants. He wants the bill passed, but he doesn’t think the sky falls if it doesn’t.
“The World Is Going to Go On”
Giancarlo made his case with a historical reference. “The internet is still happening, and there’s never been an authorizing statute 30 years later,” he said. “If we don’t get clarity, innovation goes on.”
That’s not a dismissal of the bill. Giancarlo said he’d like to see it pass and pointed to specific provisions he values, including the reauthorization of LabCFTC, the innovation center he launched during his time at the agency. He called for every financial regulator in Washington to have a similar in-house innovation center.
But he warned that the market should prepare for a reality where the bill does not pass. He believes that “the world is going to go on” regardless.

Why XRP Holders Should Pay Attention
The XRP community has watched the CLARITY Act closely. The bill would establish a regulatory framework dividing oversight of digital assets between the SEC and CFTC. For XRP, which spent years in legal limbo after the SEC’s lawsuit against Ripple, regulatory clarity has never been abstract.
The asset secured its clarity through the court. However, the bill would put XRP’s commodity status into law. As a result, the XRP community has been among the most vocal supporters.
However, Giancarlo’s point is that the absence of formal legislation doesn’t stop the industry from moving forward. Ripple’s legal battle was resolved on its own terms. XRP reclaimed exchange listings without an act of Congress and the ecosystem kept building.

Looking Ahead
Democrats have withheld floor support, with ethics provisions as the main sticking point. Congress now heads into its August recess without a vote scheduled, and analysts have said missing the August window puts 2026 passage in serious doubt.
Giancarlo’s message to the industry is not to give up on the bill. It’s to stop tying confidence to it. Legislation helps, but technology has never waited for permission. The CLARITY Act may pass, but if it doesn’t, the work continues anyway.
