Senator Elizabeth Warren has not softened her position on the CLARITY Act. In a video circulating on X, posted by crypto news account Whale News Daily, Warren delivered some of her harshest remarks yet on the legislation.
She called the bill “insulting to the American people” and tied it directly to President Trump’s crypto interests. “Donald Trump has made clear what his scam is,” Warren said.
Warren Names Her Targets
Warren did not limit her criticism to Trump. She pointed to what she sees as a systemic failure in the bill’s handling of criminal activity. “Criminals are able to step up their activity because crypto gives them that special advantage to be able to get the money and hide who they are,” she said.
She also raised concerns about terrorism financing and what she described as “shadow banking” risks posed by the legislation’s current structure. She argues that lawmakers understand the problems and a bill is moving, but those problems still went unfixed.

The Bill Warren Is Fighting
The CLARITY Act passed the House in July 2025, and the Senate Banking Committee advanced it 15-9 in May 2026. It now sits on the Senate Legislative Calendar but has no scheduled floor vote.
The bill divides crypto oversight between the SEC and CFTC. It establishes regulatory definitions for digital assets and sets consumer protection standards. Supporters argue it would end years of enforcement-by-litigation and give the industry legal clarity it has lacked since Bitcoin’s inception.
Senate Republicans need between 7 and 9 Democratic votes to clear the 60-vote cloture threshold. Recent reports suggest 7 to 10 Democrats are showing support.
Lummis Pushes Back
Senator Cynthia Lummis has led the charge for the bill and has grown visibly frustrated with the stall. She recently took to the Senate floor and said, “After nearly 11 months of giving almost everything asked of us, I genuinely don’t know what else my Democrat colleagues need before we act.”

Lummis released an updated 616-page draft on July 22 that included new ethics provisions. One of those provisions bans the president, vice president, and members of Congress from issuing or sponsoring digital assets. Lummis cited over 100 Democratic-backed changes incorporated over 11 months of negotiations.
The Clock Is Running
The Senate heads into its August recess this week. Majority Leader John Thune has signaled skepticism about getting the bill to the floor in time. If the bill misses the window, analysts say passage likely shifts to 2027, and Lummis has suggested it could be delayed until 2030. Warren’s remarks make clear she intends to keep the pressure on regardless of the timeline.
