Update for XRP Holders: SEC/CFTC Official Rulemaking Timeline Revealed

Crypto researcher SMQKE (@SMQKEDQG) shared a regulatory timeline for the official SEC/CFTC rulemaking period for digital assets. The timeline places Joint Rulemaking between late 2026 and 2027, with Full Implementation arriving in early 2027. For XRP holders and exchanges, the clock is now running.

The Timeline and What it Shows

SMQKE’s timeline traces the legislative process from Senate Committee Markup, originally projected for mid-March 2026, through to full compliance. The table projects that a Full Senate Vote would have moved the bill to the President’s desk by April or May 2026.

A Presidential Signing in June 2026 would have triggered a Provisional Registration period, during which exchanges could register with the CFTC to avoid enforcement actions. The two highlighted rows are the most significant.

The Joint Rulemaking Period, estimated for late 2026 through 2027, requires the SEC and CFTC to finalize joint rules on token classification and custody. Full Implementation in early 2027 ends an 18-month grace period, after which all platforms must be in full compliance.

The CLARITY Act’s Collapse Changed the Path

The timeline SMQKE published assumed legislative success. The CLARITY Act failed its Senate cloture vote on September 15, falling 11 votes short of the 60 required. Every Democrat present voted against it.

The bill’s failure did not stop the regulators. SEC Chair Paul Atkins stated the agency would proceed within its statutory authority. The CFTC followed the same line. Within days of the vote, both agencies moved.

The SEC issued the Innovation Exemption on September 17, opening a 5-year conditional pathway for tokenized stock trading. The CFTC issued a no-action position for passive software providers the same day. The SEC proposed a crypto custody rule for investment advisers on October 1.

The agencies are building the rulebook through exemptions, proposals, and guidance rather than statute. The destination remains the same, but the path changed.

XRP and the Joint Rulemaking Window

XRP is one of the 16 assets classified as digital commodities under a joint SEC/CFTC interpretation finalized in March 2026. The Joint Rulemaking Period will determine how custody requirements are enforced, and how token classification rules apply.

These rules will shape how exchanges handle XRP and how institutions engage with the asset. The late 2026 to early 2027 window SMQKE identifies now carries more significance given the legislative failure. Agency rulemaking has become the primary vehicle.
