Current Status of the CLARITY Act
The CLARITY Act is close to a vote in the Senate. Senate Majority Leader John Thune filed cloture before lawmakers left for the August recess. That filing secures the bill floor time when the Senate returns. The cloture vote is scheduled for September 15, 2026, at 2:15 PM.
Senator Bernie Moreno has stated that negotiations are finished. “There is absolutely nothing to ‘iron out,’” he said. He confirmed that all 53 Senate Republicans are expected to vote in favor of cloture. The bill needs 60 votes to advance past the cloture threshold, meaning at least 7 Democrats must cross over.
The main organized opposition has come from the banking lobby, but Senator Cynthia Lummis has pushed back hard. Former House Financial Services Committee Chairman Patrick McHenry addressed the banking lobby’s push. He told Bloomberg the effort is “falling on deaf ears.” McHenry predicted the bill will pass before the end of 2026.

September 15 Is the Key Date
All attention now turns to September 15. Republicans have the votes to move forward. The question is whether enough Democrats join them to clear the 60-vote threshold. The early indicators are favorable, as reports indicate between 7 and 10 Democrats are prepared to support the legislation.
